1. field of application

1.1. The goods offered in our online store are intended exclusively for consumers with a delivery address in Switzerland.

1.2. These General Terms and Conditions of Sale (hereinafter referred to as "GTCS") apply to all orders placed on the www.oliviersandco.ch website as well as by telephone, email, WhatsApp or any other means of communication. By placing an order, every customer implicitly accepts these General Sales Conditions. Our customers cannot cancel, modify or replace these General Terms and Conditions of Sale.

2. CONTRACT CONCLUSION

2.1. The sales contract is concluded when Medsol Sarl (Oliviers & Co Suisse) located 8, place Bourg de four 1204 Genève under the RC Number CHE-109.061.379 has confirmed the order in writing (example by email for any order on our online shop).
An order confirmed by Oliviers & Co (Suisse)  can no longer be cancelled.
By placing an order, all customers attest to being 18 years of age or older and attest on their honor to the validity of the information they provide.

2.2 In accordance with Art. 185 of the Swiss Code of Obligations, goods are shipped at the purchaser's risk, on the principle that profits and risks pass to the purchaser upon conclusion of the contract. The purchaser is obliged to check the condition of the articles received and undertakes to be responsible for the preservation of the product.

2.3 This sale must not, under any circumstances, give rise to any other uncontrolled business without the consent of Oliviers & Co (Switzerland).

2.4. The data saved by us serves as proof of the conclusion of the contract and the transaction. Oliviers & Co (Suisse) reserves the right to cancel any order if any information provided by the buyer proves to be false.

2.5. During the ordering process, the customer can print out his order and the data he has entered. The customer may also open a customer account. Within the customer account, it is possible to consult the order data after entering the personal access data. Oliviers & Co (Switzerland) reserves the right to block customer accounts at its own discretion and without giving reasons.

3. PRODUCTS

3.1
The product must be consumed within the date indicated on the packaging.

3.2. The sale of products containing alcohol (wines, spirits) to persons under the age of 18 is prohibited in Switzerland and the European Union. By placing an order in the online store, the customer acknowledges these regulations and confirms that he/she is authorized to proceed with the purchase.

3.3. Products appearing on the website are offered within the limits of available stocks. In the event of missing goods, Oliviers & Co (Switzerland) undertakes to return the products as soon as possible.

3.4. Validity of the offer: Offers on the site are valid for the time they are online. The photographs illustrating the products are not part of the contract and are merely indicative of the general presentation of the product.

 

4. PRICES

Our prices are in Swiss Francs, all taxes included (VAT in force), excluding shipping costs. Shipping costs for Switzerland are added at checkout.
All our offers are non-binding. Oliviers & Co (Suisse) reserves the right to modify prices at any time.

 

5. PAYMENT

5.1. Payment is made online, when the order is placed, either :

-By credit card (Visa/Visa Electron, Mastercard, American Express). In this case, you will be redirected to Worldline's secure site (Saferpay), which guarantees the confidentiality of the data transmitted (notably card number, validity date, visual cryptogram on the back of the card) by means of protection and encryption procedures. The order can only be dispatched once it has been accepted by the bank.

-Twint is a payment service (QR code) that allows you to pay in online stores securely, easily, quickly and free of charge.

5.2. The delivered goods remain the legal property of Oliviers & Co (Switzerland) until full payment.

6. DELIVERY AND TRANSFER OF RISK

6.1. Oliviers & Co (Suisse) undertakes to deliver throughout Switzerland within 96 H from confirmation of order acceptance.

Our deliveries are carried out:
- Either by the Post Office
- Or by our own delivery service for the Canton of Geneva and Canton of Vaud.
These times are given as an indication and exceeding these times cannot engage the responsibility of the seller nor give rise to cancellation of the contract or payment of compensation.

Delivery charges are extra:

-  9.70 CHF (2 working days)

-  These shipping costs are free as soon as your order exceeds 250.-CHF.

6.2. We are entitled to make partial deliveries at the customer's request. If, after conclusion of the contract, it becomes apparent that the goods cannot be delivered, either in part or in full, for reasons for which the seller is not responsible, the customer is entitled to withdraw from the contract.

6.3. Our service consists of an obligation to ship; it is fulfilled when the shipment is handed over to the person in charge of transport. After dispatch, the risk of accidental damage to or loss of the goods passes to the customer. We are not liable for any fault on the part of the carrier.

6.5. Delivery contracts concluded with us are subject to Swiss law and to the price changes of our partner (La Poste.ch).

7. RIGHT OF WITHDRAWAL AND RETURNS

7.1. Due to their perishable nature, we do not grant any right of withdrawal or return on our products.
We take the utmost care with your order. In the event that, despite all our care, you should have a complaint about our products, upon receipt of your order, requests are dealt with on a case-by-case basis.
In all cases, the purchaser undertakes to check the goods on receipt to ensure that they are complete and in good condition. Any complaints concerning quality and completeness must be communicated to Oliviers & Co (Switzerland) immediately, and at the latest within 24 hours of delivery, otherwise the delivery will be deemed to have been accepted. For all complaints, please send a photo of the product and the back label immediately by email or What's ap .

7.2. Oliviers &Co (Suisse) cannot be held responsible for damage occurring during transport or resulting from incorrect storage of the goods after receipt by the customer or his partners.

 

8 INTELLECTUAL PROPERTY

Oliviers & Co SA, headquartered at ZONE ARTISANALE DE PITAUGIER 04300 MANE, registered with the RCS of MANOSQUE under number 404 375 461.

Is the owner of all trademarks, names, titles, logos, images, designs, texts and other materials are entities of right belonging to Oliviers & Co SA having its registered office at ZONE ARTISANALE DE PITAUGIER 04300 MANE .


The consultation, downloading or copying of pages does not imply the acquisition of rights (exploitation rights, intellectual property rights). Reproduction (in whole or in part), distribution (electronically or by other means), modification or use of the website for public or commercial purposes is prohibited without prior written authorization.

9.1. The customer hereby agrees to the storage of personal data entered by him/her in connection with the use of our website. This consent also applies to the storage of the IP addresses transmitted each time the website is used. Access to and use of the website cannot be guaranteed.

 

11. APPLICABLE LAW AND JURISDICTIONAL JURISDICTION
These conditions are subject to Swiss law.  The exclusive place of jurisdiction is Geneva [GE], subject to appeal to the Swiss Federal Court.
